Ⅰ．医療事故と訴訟

1．医療事故

　“To Err is Human”（誰でも人は過ちを犯す）¹¹⁾．日本でもあまりにも有名になったこの格言は，もともとイギリスの詩人，Popeの残した“To err is human， to forgive divine”（過つは人，許すは神）から引用した言葉です．これは「Institute of Medicine」という学術団体が，これからも医療事故はどうしてもなくならない大きな医療界の課題であるとして投げかけた言葉です．毎年，アメリカでは44,000～46,000人が医療事故で死亡し，全米での死亡順位の第8位，その数は交通事故死（43,458例）の2倍，乳癌（42,297例）をも凌ぐと報告しました．これにはMRSAなどの院内感染や薬剤副作用によるSteven Johnson Syndromeなども含まれており，過大評価の感がないでもありませんが，ショックな数字です．これに伴う経済的損失を年間，17～29billion dollar（200～300億円）と算定しています．

　リスクマネジメントはアメリカで50年間，言われてきました．はじめはエラーの低減とは関係なく，いかに保険料を抑制するか，訴訟を起こさせないための方法論とされてきました^12,13)．別の統計を見ますと，入院患者の事故発生率は2.9（California Study）～4.7％（Harvard Study），そのうち死亡したのが6.6～13.6％を占め，うち約30％は医療提供者の過失責任とされています．100人のうち4人が障害に遭い，そのうち1人は医療上での過誤によるものとされているのです^3,6)．
