認知症とともに生きる人々のための権利と権利ベースのアプローチ

はじめに
スコットランドは，認知症とともに生きる人々の「権利」を世界に先駆けて明確に打ち出したパイオニアであり，リーダーである。2009年には，当事者参画による『スコットランド認知症の人とケアラーの権利憲章』(以下，『権利憲章』)28)が策定された。この権利憲章の基盤にあるのは，1990年代後半より国際連合(以下，国連)機関が推進しているRights-Based Approach/権利ベースのアプローチ(以下，RBA)35)と，2006年に国連で採択された「障害者の権利に関する条約」(以下，「障害者権利条約」)36)である。その後のスコットランドの一連の認知症政策，指針，実践においても，それぞれすべての基盤にあるのはRBA，「障害者権利条約」，『権利憲章』である。そして，認知症政策，指針，実践の策定過程においても，RBAに不可欠な「当事者参画」が確保された。
近年，このスコットランド発「認知症と権利」の動きが，急速に国際的な拡がりをみせている。2015年に世界保健機関(WHO)が，認知症とともに生きる人々の権利やRBAの重要性を強調した40)のを筆頭に，現在，認知症権利運動(dementia rights movement)が国連をも巻き込んで国際展開している状況である19)。この運動を牽引しているのは，認知症当事者団体「国際認知症同盟(Dementia Alliance International)」や，「国際アルツハイマー病協会(Alzheimer's Disease International)」など，国際レベルで活動する市民団体や組織である4,9)。
国レベルでも，スコットランドを超えてイギリス全体で認知症権利運動が加速しており，とりわけイギリス当事者団体「認知症政策シンクタンク(Dementia Policy Think Tank)」，イギリス当事者団体全国ネットワーク「ディープ(DEEP：Dementia Engagement and Empowerment Project)」，「メンタルへルス財団(Mental Health Foundation)」の活動が注目に値する10,17)。また2017年5月に当事者参画により策定されたイギリスの『認知症声明』では，5つの声明すべてに「権利」が掲げられ，それら権利は国際人権規約で守られた権利であることが明記された8)。
これら市民団体による認知症権利運動と並行して，最新の動向で注視すべきは，イギリスの障害者分野の研究者らが，障害権利(disability rights)の理論，運動，実践の長年の実績を応用しながら，新鮮な視点で「認知症と権利」の議論，特に「認知症とともによく生きると権利」の議論を展開し，その発展に寄与していることである30)。
こうしたスコットランドをはじめとして，国際的に認知症と権利の議論が展開し，実際に権利やRBAを基盤に置く認知症政策や実践が確立されてきているのとは対照的に，日本では，「認知症と権利」の建設的な議論はまだ端緒についたばかりである。その一因には「権利」の概念が否定的に受け止められることもある歴史，文化，社会的要素が挙げられよう37,41)。そこで本稿では，日本で「認知症と権利」や「認知症とともによく生きると権利」の議論を展開していく前提として，基礎理解に寄与することを目的に，主にスコットランドを例に挙げ，RBAに不可欠な当事者参画，認知症の人の権利，RBAについて概観する。その上で，近年日本を含む世界の先進諸国において，認知症政策や実践の共通目標として台頭し確立してきた「認知症とともによく生きる」ことについて，認知症の人の権利と関連させながら批判的に考察する。
